Due to recent events I feel it is necessary to let all of you know the situation currently with Kalaeloa Raceway Park.
On Monday morning, June 16th, we filed suit against DHHL and the Hawaiian Homes Commission due to their failure to adopt proper policy in violation of state law required by Chapter 91 HRS, their conspiracy to damage our reputation and business, as well as their negligent infliction of emotional distress. Their failure to properly adopt rules and regulations to establish proper policy for handling of the Hawaiian home lands, in effect, voids their current permitting and right of entry system.
This situation affects not only us, but all tenants under their new right of entry system.
While serving the lawsuit to DHHL, we discovered that a Hawaiian Homes Commission Meeting was being held that same morning with the intent to vote on several key issues concerning KRP. We were not notified of this meeting nor were we invited to testify on our behalf although our usual very vocal and malicious minority opponent was.
As many of you know, we have attempted to rectify our current situation with DHHL several times but were left hanging due to the HHC's failure to hold quorum on three separate occasions. Because of this, we formally requested a Contested Case Hearing so that we could present our case to the Commission and attempt to rectify our situation.
Item C-2 on Monday's meeting agenda was our request to hold the above hearing. DHHL recommended to the HHC members that this request be denied to which HCC voted in agreement. The end result is that we were allowed absolutely zero opportunity to present our case to the commission.
In addition, at this same meeting the Commission voted to revoke our permit for the property and effectively shut down our current operations.
This corruption and discrimination stems from the Governor's office...we do not have the support of our Governor Neil Abercrombie. However, we do have the support of Senator Clayton Hee as well as Senator Maile Shimabukuro. Of special note was the support of HHC member, Renwick “Uncle Joe” Tassil, who symbolically excused himself from the voting in protest of our treatment. We thank them for their support.
For now, have to let the legal proceedings follow its course. Until then, it is business as usual for the foreseeable future. We will continue to hold our events and invite all of you to join us in support.
From the beginning, this has about providing a home for our community of displaced motorsports enthusiasts as well as their families and friends. It's about you, the racer...this is your fight as well as ours.
We will not give up, and we will fight to keep everything that we have accomplished together.
